TERMS
AND CONDITIONS
1.
Whereas The Voice Clinic (PTY) Ltd. (hereinafter referred to
as "the CLINIC") presents courses for clients to improve
speech and vocal techniques and to increase communication, confidence
and public speaking skills.
1.1 The client is desirous of completing these courses within
a maximum time period of 4 (four) months. Should the client
fail to complete the course within that period the client will
forfeit the remainder of the course and will not be entitled
to a refund from the clinic.
1.2
The clinic and the client have reached agreement as to the terms
upon which the services of the clinic are to be engaged by the
client subject to such terms being recorded in writing.
2. All amounts due and payable by the client to the clinic shall
be paid prior to or upon the commencement of the particular
course and should the client not start or complete a particular
course for any reason whatsoever, he/she will be liable for
payment of the balance of the full fees and will not be entitled
to receive a refund from the CLINIC.
2.1 The client agrees that interest may be charged at the sole
discretion of the clinic on overdue accounts at the rate of
2.25% per month compounded and debited monthly.
2.2 All voice lessons need to be cancelled 24 hours in advance.
Failure to cancel will result in a R350.00 cancellation fee
for each session not cancelled in advance. Group courses need
to be cancelled 2 weeks in advance of commencement date. Failure
to cancel will result in the entire group course fee being forfeited.
2.3 No indulgence which the clinic may show to the client at
any time and no extension which it may grant to the client in
accepting late payment of course fees shall be in any way regarded
as or deemed to be a waiver by the clinic of any of it's rights
under this agreement. Should payment not be received by the
agreed dates The Voice clinic will be entitled to debit my credit
card for the outstanding amounts.
2.4 Should the clinic institute action against the client pursuant
to a breach by the client of its agreement, the clinic shall
be entitled to recover from the client all reasonable legal
costs incurred by it including attorney/client charges, tracing
fees and such collection commission as the clinic is obliged
to pay to it's attorneys, from the client.
3.
The client shall during the duration of any course at any time
thereafter keep confidential and not divulge or disclose to
any person, firm, close corporation or company, information
relating to the business and/or undertaking of the clinic including
information relating to it's financial affairs, business and
the business of it's clients.
4.
All course notes and other documentation shall become the sole
and absolute property of the client upon payment of the prescribed
fee. The client undertakes not to make copies or distribute
any course notes or other documentation provided. The client
undertakes not to utilise course notes, ideas and exercises
used by The clinic for the client's financial or professional
gain.
5.
The client indemnifies the clinic and holds it harmless from
and against any and all claims, actions, damages, liability
and expense in connection with personal injury arising from
or out of any act carried out by the client in the duration
of the course.
6.
This agreement constitutes the sole contract between the parties
and no alteration, variation or extension or departure from
any such terms in any way whatsoever shall be of any force or
effect unless recorded in writing and signed by both parties.
